1. Agreement
These Terms of Service ("Terms") govern your access to and use of Emailingo (the "Service"), operated by Tiny Electrons LLC ("Emailingo", "we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to be bound by these Terms.
If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business. In that case, "you" refers to the business.
2. Description of Service
Emailingo is an outbound email platform. It consists of:
- A web application for managing sending domains, contact lists, templates, campaigns, A/B variants, segmentation, and analytics.
- An outbound email-delivery pipeline that sends from domains you connect and authenticate via SPF, DKIM, and DMARC.
- Optional unsubscribe and preference pages presented to your recipients on links generated by the platform.
- An API and PostgreSQL data store hosted on our infrastructure.
The Service is offered on a free tier and on paid subscription plans, billed monthly. You can change plans or cancel at any time, effective at the end of the current billing period.
3. Accounts
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of credentials issued to your administrators and for all activity under your account. We strongly recommend enabling MFA on every administrator account; the Service offers TOTP-based MFA built in.
You must promptly notify us of any unauthorized use of your account or any other security incident at security@emailingo.com.
4. Sender Responsibilities & Acceptable Use
You are the sender of record for every email campaign sent through your Emailingo account. You agree that you will:
- Have a lawful basis to email each recipient under applicable law in their jurisdiction (e.g., consent, prior business relationship, or another permitted basis under CAN-SPAM, CASL, GDPR/UK GDPR, ePrivacy, and any other law that applies to your sending).
- Include a working unsubscribe mechanism and a valid postal address in marketing messages, as required by CAN-SPAM and equivalent rules. Emailingo provides unsubscribe-link generation; you remain responsible for the content of your messages.
- Honor unsubscribe requests promptly. The Service will automatically suppress addresses that unsubscribe through links it generates.
- Send only from sending domains you own or are authorized to send from, with SPF, DKIM, and DMARC properly configured.
- Maintain reasonable list hygiene — not import purchased lists, scraped lists, or lists obtained without permission.
You agree not to, and will not permit your team or end-users to:
- Send spam, phishing, malware, fraudulent, deceptive, or otherwise unlawful messages.
- Forge headers, misrepresent the sender, or send on behalf of a third party in a way that is misleading.
- Use Emailingo to send messages whose primary purpose is to harass, defame, or threaten any person.
- Send to addresses on the Service-wide global suppression list, or attempt to circumvent suppression by re-importing addresses that have unsubscribed.
- Bypass throttling, warmup limits, or per-domain sending caps that the Service applies to protect deliverability.
- Reverse-engineer, decompile, or disassemble the Service except where expressly permitted by law.
- Interfere with or disrupt the Service, including by sending abusive traffic to our endpoints.
- Resell, white-label, or sublicense the Service without a written agreement.
We may suspend or terminate accounts that violate these rules or that generate sustained spam complaints, hard bounce rates, or abuse reports above industry-acceptable thresholds, in order to protect the deliverability of other Customers on the platform.
5. Customer Data
You retain all rights, title, and interest in the data you submit to the Service ("Customer Data"), including the contact records you import, the templates you author, the campaigns you run, and the engagement events those campaigns generate. You grant Emailingo a limited license to process Customer Data solely as necessary to provide the Service, support it, protect deliverability, and comply with applicable law.
How we collect, use, and retain Customer Data is described in our Privacy Policy. A separate Data Processing Addendum is available on request for customers subject to GDPR/UK GDPR.
6. Sending Domains & Deliverability
The Service requires you to authenticate the domains you send from with SPF, DKIM, and (recommended) DMARC. You are responsible for the DNS configuration of those domains. New domains undergo a warmup period during which sending volume is gradually ramped to protect domain reputation.
Emailingo monitors public blacklists, ISP feedback loops, and bounce signals to protect platform deliverability. We reserve the right to throttle, pause, or temporarily disable sending from any domain that exceeds reasonable bounce, complaint, or unsubscribe thresholds, and we will notify the account owner when we do so. We do not guarantee any specific deliverability or inbox-placement rate — those depend on factors outside our control, including your content, your list quality, your sending history, and recipient-side filtering.
7. Subscription & Billing
- Plans: the Free, Growth, and Business plans (and any successor or custom plan) as described on the pricing page.
- Billing cycle: monthly in advance, starting on the date you subscribe to a paid plan.
- Payment: via Stripe, the payment processor disclosed at checkout. You authorize recurring charges. Card data is collected by Stripe directly and never reaches Emailingo servers.
- Plan limits: features and monthly send quotas (the number of email messages you may send per month) are set by your active plan. When you reach a limit, sending pauses or queues until the next cycle or until you upgrade.
- Taxes: prices are exclusive of taxes; you are responsible for any applicable sales, use, or VAT.
- Refunds: we do not offer pro-rated refunds for partial months. You can cancel at any time and the cancellation takes effect at the end of the current billing period.
8. Term & Termination
These Terms remain in effect while you have an account. Either party may terminate the agreement for any reason effective at the end of the current billing period.
We may suspend or terminate your access immediately if you (a) breach these Terms, (b) fail to pay amounts owed, or (c) use the Service in a way that creates a security, abuse, deliverability, or legal risk to us, our upstream email-delivery providers, your recipients, or other Customers. We will provide notice except where doing so is impractical or would cause additional harm.
On termination, you may export Customer Data via CSV exports in the app or via the API for 30 days. After 30 days, Customer Data is deleted from production systems; backup copies are deleted on the next backup-rotation cycle. Suppression-list entries (addresses that unsubscribed or hard-bounced) may be retained longer where required to comply with anti-spam laws.
9. Service Availability & Support
We make commercially reasonable efforts to keep the Service available and performant. The Service may be temporarily unavailable for scheduled maintenance, updates, or factors outside our reasonable control (including upstream email-delivery providers, DNS providers, and recipient-side mail systems).
We provide best-effort support via support@emailingo.com. Paid plans receive priority response. Specific service-level commitments, if any, are documented in a separate Service Level Agreement applicable to your subscription tier.
10. Security
We maintain a written information security program with administrative, technical, and physical safeguards appropriate to the nature of Customer Data processed. Highlights are listed in the Privacy Policy. You remain responsible for the strength and protection of your administrators' credentials, for keeping the email addresses tied to your account current, and for the security of any DKIM private keys you generate outside the Service and provide to it.
11. Updates
We may update the Service from time to time, including releasing new features, refining pricing tiers, and retiring features that are no longer used. We will not materially diminish core functionality on a paid plan during your subscription period without notice.
12. Confidentiality
Each party will protect the other's Confidential Information using the same degree of care it uses for its own confidential information of like importance, and not less than reasonable care. Confidential Information does not include information that is publicly known, independently developed, or rightfully received from a third party without obligation of confidentiality.
13. Warranties & Disclaimers
We warrant that the Service will materially conform to the documentation provided in the application and at emailingo.com. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND WE DO NOT WARRANT ANY SPECIFIC INBOX-PLACEMENT, OPEN, CLICK, OR REPLY RATE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT WILL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOST DELIVERABILITY, OR BUSINESS INTERRUPTION). EACH PARTY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES PAID BY CUSTOMER TO EMAILINGO IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless Emailingo and Tiny Electrons LLC against any third-party claims arising from (a) the content of email you send through the Service, (b) your sending to recipients without a lawful basis, (c) your violation of CAN-SPAM, CASL, GDPR/UK GDPR, ePrivacy, or other applicable law, (d) your misuse of the Service, or (e) your violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in Delaware, and the parties consent to the personal jurisdiction of those courts.
17. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated to account owners via email and announced inside the application at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
